Terms of Use for EduSwipe

1. Acceptance of Terms

By downloading, accessing, or using the EduSwipe mobile application ("App"), you agree to be bound by these Terms of Use ("Terms") and our Privacy Policy. If you do not agree to these Terms, do not use the App.

2. License to Use the App

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the App on a mobile device that you own or control, solely for your personal, non-commercial educational purposes.

3. User Content and AI Generation

  • Responsibility: You are solely responsible for the PDF documents ("User Documents") you upload to the App.
  • Rights: You represent and warrant that you own or have the necessary licenses, rights, consents, and permissions to upload the User Documents and to allow the App and its integrated third-party AI service (currently Google Gemini) to process the content for the purpose of generating learning materials ("Generated Content"). You agree that you will not upload any content that infringes upon any third party's rights (including copyright, trademark, privacy, or other personal or proprietary rights) or contains illegal material.
  • Ownership: We claim no ownership rights over your User Documents or the Generated Content derived from them. They remain your property.
  • AI Service: You acknowledge that the generation of learning materials relies on a third-party AI service. The quality, accuracy, and appropriateness of the Generated Content depend on both your User Document and the capabilities and limitations of the AI service.

4. Subscriptions

  • Premium Features: The App offers enhanced features or usage limits through automatically renewing subscriptions ("Subscriptions"). Available subscription plans (weekly, monthly, yearly) and their current prices are displayed within the App prior to purchase.
  • Payment: Payment will be charged to your Apple ID or Google Play Store account ("Store Account") upon confirmation of purchase.
  • Automatic Renewal: Your Subscription will automatically renew for the same duration and price unless you turn off auto-renewal at least 24 hours before the end of the current subscription period. Your Store Account will be charged for renewal within 24 hours prior to the end of the current period.
  • Management and Cancellation: You can manage or cancel your Subscription's auto-renewal by accessing your Store Account settings after purchase. No cancellation of the current subscription is allowed during the active subscription period. If you cancel, you will retain access to the premium features until the end of your current paid period.
  • Platform Terms: Your purchase and use of Subscriptions are also subject to the terms and conditions of the platform from which you downloaded the App (Apple App Store or Google Play Store).

5. Intellectual Property

Excluding your User Content and Generated Content derived from it, all rights, title, and interest in and to the App itself, including its design, software, code, graphics, text, and other components ("App IP"), are and will remain the exclusive property of EduSwipe and its licensors. The App IP is protected by copyright, trademark, and other laws. You may not copy, modify, distribute, sell, or lease any part of our App IP.

6. Disclaimers

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE APP AND YOUR USE THEREOF, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE MAKE NO WARRANTIES OR REPRESENTATIONS ABOUT THE ACCURACY, COMPLETENESS, OR RELIABILITY OF THE APP'S CONTENT OR THE GENERATED CONTENT PRODUCED BY THE INTEGRATED AI SERVICE. THE USE OF AI-GENERATED CONTENT IS AT YOUR OWN RISK; YOU SHOULD VERIFY ANY CRITICAL INFORMATION INDEPENDENTLY.

7. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, LOSS OF DATA, OR OTHER DAMAGES ARISING FROM YOUR USE OF THE APP OR THE GENERATED CONTENT, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

8. User Conduct

You agree not to use the App to:

  • Upload any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable.
  • Violate any applicable local, state, national, or international law.
  • Infringe upon or violate our intellectual property rights or the intellectual property rights of others.

9. Termination

We may terminate or suspend your license to use the App, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the App will immediately cease.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Germany, without regard to its conflict of law provisions.

11. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our App after any revisions become effective, you agree to be bound by the revised terms.
